2025 BUCKED UP® x RAILBIRD Sweepstakes OFFICIAL RULES
1. SWEEPSTAKES PERIOD: Sweepstakes begins at 12:00:00 a.m. MT on May 9, 2025 and ends at 11:59:59 p.m. MT on May 23, 2025. (“Sweepstakes Period”).
2. HOW TO ENTER THE SWEEPSTAKES: NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANGES OF WINNING. There are TWO (2) methods of entry into the Sweepstakes:
1. Text Entry (Standard Text Messaging Rates Apply): During the Sweepstakes Period, you may enter by texting the keyword RAILBUCK to 888-271-4225 using a mobile device. Upon receipt of a valid keyword, you will receive a reply text message confirming your entry and opting you in to receive further text messages related to this Sweepstakes. You will receive one (1) Sweepstakes entry per eligible text.
1. By participating via text message, you consent to receive promotional and administrative text messages from the Sponsor and/or its agents related to the Sweepstakes. Message and data rates may apply.
2. Text messaging and wireless service are not available in all areas and not all mobile devices or wireless carriers are supported. Check your mobile device capabilities and carrier for specific text messaging instructions and fees. You may opt out of receiving further messages at any time by replying STOP. For assistance, reply HELP.
3. Limit one (1) text entry per person per day during the Sweepstakes Period.
4. Entrants are solely responsible for any charges, including text messaging fees, imposed by their wireless carrier.
5. Text entries must be received by 11:59 p.m. MT on May 23, 2025, to be eligible.
2. Free Mail-in Entry (No Purchase Necessary): To enter the Sweepstakes without making a purchase, hand-print your full name, complete mailing address (no P.O. Boxes), email address, and phone number on a plain 3” x 5” card or paper, and mail it in a #10 business-size envelope with proper postage to: 2025 BUCKED UP® x RAILBIRD Sweepstakes, BUCKED UP HQ, 815 W. University Pkwy, Orem, UT 84058
1. Each mail-in entry must be mailed separately.
2. No mechanically reproduced or photocopied entries permitted.
3. All mail-in entries must be postmarked by May 23, 2025, and received by May 25, 2025 to be eligible.
4. Limit ten (10) free mail-in entries per person during the Sweepstakes Period.
Individuals are limited to a maximum of one (1) Sweepstakes entry per day, regardless of method of entry.
3. ENTRY CONDITIONS, VALIDATION & DISQUALIFICATION: Proof of entering via text or mail-in entry does not constitute proof of delivery to or receipt by Sponsor of an entry. Entries must be submitted as specified in these Official Rules to be valid. Any entry that does not comply with the entry requirements will be deemed void and disqualified.
Entries submitted by any person or entity other than the entrant, or originating from any other website or email address (including, but not limited to, commercial sweepstakes subscription services or entry aggregation platforms), are void and will be disqualified. The use of any automated, programmed, or mechanical means of entry—including, but not limited to, scripts, bots, macros, or sweepstakes services—is strictly prohibited. All entries must be manually key-stroked and manually submitted by the entrant. Mechanically reproduced entries are void.
ANY FRAUDULENT ACTIVITY IN CONNECTION WITH THIS SWEEPSTAKES IS STRICTLY PROHIBITED. This includes, but is not limited to, making purchases to obtain entries with the intent to return those purchases after entry. Any entrant found to be engaging in fraudulent behavior, or suspected of doing so at Sponsor’s sole discretion, will be immediately disqualified and banned from participating in this and future promotions offered by Sponsor.
The Released Parties (as defined below) are not responsible for late, incomplete, misdirected, delayed, lost, corrupted, or undelivered entries. In the event of a dispute over the identity of an entrant, the entry will be deemed to have been submitted by the authorized account holder of the email address or mobile phone number provided at the time of entry. The authorized account holder is the natural person who is assigned to the email address or phone number by the relevant service provider.
It is the sole responsibility of each entrant to notify Sponsor in writing of any changes to their email address, phone number, or mailing address during the Sweepstakes Period. All entries become the property of Sponsor and will not be acknowledged or returned, except as otherwise provided herein.
By entering the Sweepstakes, entrants consent to the collection and use of their personal information by Sponsor and its agents for the purposes of administering this Sweepstakes and as otherwise described in Sponsor’s Privacy Policy, found at https://www.buckedup.com/information/privacy-policy.
4. ELIGIBILITY: The Sweepstakes is open only to legal residents of the fifty (50) United States who are eighteen (18) years of age or older at the time of entry.
The following individuals are not eligible to participate or win a prize: employees, officers, and directors of DAS LABS, LLC d/b/a BUCKED UP (“Sponsor”), its manufacturers, bottlers, subsidiaries, affiliates, advertising and promotion agencies, promotional partners, prize suppliers, and any other entities involved in the administration or execution of the Sweepstakes (collectively, the “Sponsor and Promotion Parties”), as well as the immediate family members (defined as spouse, parent, child, sibling, or household member) of each such employee, officer, or director, whether or not related.
5. PRIZES: There will FIVE (5) Grand Prizes available to be awarded.
1. GRAND PRIZE: Each Grand Prize consists of TWO (2) 2-Day General Admission tickets to attend the Railbird Music Festival in Lexington, KY on May 31 – June 1, 2025. Approximate Retail Value (“ARV”) of each Grand Prize: $500.
Transportation, lodging, and all other expenses are NOT included as part of the prize. Actual value may vary based on point of departure, travel dates, and market conditions at time of fulfillment. Any difference between the stated ARV and actual value of the prize will not be awarded.
If a potential winner is unable or unwilling to attend the Event on the dates designated by Sponsor, the prize will be forfeited and may be awarded to an alternate finalist, in Sponsor’s sole discretion.
Each winner’s guest must be at least 18 years of age or the winner must be the guest’s parent or legal guardian. Guest must execute and return a liability/publicity release prior to ticket delivery, where legally permissible.
Tickets will be delivered to winners via either email, mobile app, or will call prior to the event. Delivery method will be chosen at Sponsor’s sole discretion.
All expenses and incidental travel costs not expressly stated in the prize description above, including but not limited to meals, ground transportation, gratuities, personal purchases, and any other costs or expenses not explicitly listed, are the sole responsibility of the winner. No refund or compensation will be made in the event of the cancellation or delay of any flight.
Attendance at the Event is subject to availability, venue capacity, and compliance with any applicable venue, production, or health and safety requirements, which may include vaccination status, testing, or mask mandates. Sponsor is not responsible if Event is delayed, rescheduled, canceled, or otherwise disrupted for any reason, including force majeure events. If the Event is canceled or otherwise unavailable, the remainder of the prize will be awarded as stated, and no compensation or substitution will be provided for the missed Event.
Prize is non-transferable and no substitution or cash equivalent will be made, except as provided herein at Sponsor’s sole discretion. Sponsor reserves the right to substitute any prize or component thereof with a prize of equal or greater value.
Limit one (1) prize per person/household.
Winners are solely responsible for any federal, state, and local taxes associated with prize acceptance and use. See Section 6 below for additional prize conditions.
Total ARV of all Prizes: $2,500.00.
6. Prize Conditions: By accepting a prize, each verified winner agrees to release and hold harmless the Sponsor and Promotion Parties (collectively, the “Released Parties”) from and against any and all claims, liabilities, damages, or causes of action arising out of participation in the Sweepstakes or the receipt, use, or misuse of any prize.
The Event associated with the Grand Prize is subject to availability, scheduling, and other restrictions, and is not guaranteed. Sponsor will not provide any compensation or substitution in the event of delay, rescheduling, or cancellation of the Event, or for any acts of God, force majeure events, or other circumstances beyond Sponsor’s control. Additional terms and conditions may apply to the Event, and all elements of the prize are awarded “as is” without any warranty, representation, or guarantee, express or implied.
Tickets (if applicable) awarded as part of the prize may not be sold, bartered, offered for resale, or used for any commercial or promotional purposes. Any such unauthorized use may result in disqualification and forfeiture of the prize. Tickets are subject to the terms and conditions set forth thereon and by the Event venue. By accepting and/or using tickets, winner and guest agree to comply with all health, safety, and security policies in effect at the time of the Event.
Sponsor is not responsible for any missed events, delays, or expenses incurred due to transportation issues, late arrival, or other circumstances outside of Sponsor’s control. Winner and guest must provide valid government-issued identification to participate in the Event and may be required to sign additional liability/publicity releases.
Sponsor reserves the right to revoke the prize or terminate the prize-related experience, in whole or in part, if the winner or their guest engage in behavior deemed inappropriate, disruptive, unsportsmanlike, threatening, abusive, or otherwise objectionable (as determined in Sponsor’s or Event organizer’s sole discretion). In such case, winner and/or guest may be removed from the premises and sent home at their own expense with no further compensation.
7. DRAWING: All potential winners will be selected in a random drawing from among all eligible entries received by 11:59:59 p.m. MT on May 23, 2025. The drawing will be conducted on or about May 25, 2025, using an independent online randomizer (www.randompicker.com). The random drawing process and results are final and binding in all matters relating to this Sweepstakes. Odds of winning any prize depend on the total number of eligible entries received throughout the Sweepstakes Period.
8. WINNER NOTIFICATION: Potential winner(s) will be notified by email and/or phone using the contact information provided at the time of entry, within approximately two (2) days following the drawing. It is the sole responsibility of the entrant to ensure that their contact information is accurate and up to date.
If a potential winner is contacted, they must respond within twenty-four (24) hours of the initial notification. Failure to respond within the required timeframe, or failure to comply with any of the requirements set forth herein, may result in disqualification and the prize being awarded to an alternate winner at Sponsor’s sole discretion.
Sponsor is not responsible for: Emails that are filtered, flagged as spam, or otherwise not received; disconnected or inoperative phone numbers; suspended or discontinued wireless service; any other issue that may prevent a potential winner from receiving or responding to the prize notification.
A potential winner may be disqualified if:
(i) the prize notification or prize is returned as undeliverable;
(ii) they fail to confirm phone message receipt or respond to email notification within twenty-four (24) hours;
(iii) any required documents, affidavits, or confirmations are not returned within the specified timeframe; or
(iv) they are unable to attend the Event (if applicable) or accept the prize as awarded.
Please allow up to three (3) business days for delivery of prize(s) following the completion of the verification process. Prizes will only be delivered to verified addresses located within the eligible United States.
9. GENERAL: This Sweepstakes is governed by applicable federal, State and local laws. Except as determined by Sponsor in its sole discretion, no substitution of prize is offered, no transfer of prize to a third party is permitted, and non-cash prizes may not be redeemed for cash value. Any gift card prizes are subject to the terms stated on the gift card or as otherwise set by the card issuer. Prize winner will be solely responsible for all applicable federal, state and local taxes on prize. Winner may receive an IRS Form 1099 for the retail value of the prize. Sponsor reserves the right to substitute a prize of equal or greater value in the event a prize or any portion of a prize becomes unavailable. Any difference between stated approximate value of prize and actual value of prize will not be awarded. Any portion of a prize not accepted by winner will be forfeited. Upon forfeiture for any reason as stated in these Official Rules, no compensation will be given. All federal, state and local laws & regulations apply. Any personal information provided in connection with participation in the Sweepstakes will only be used by Sponsor to notify a potential winner and/or fulfillment of a prize and shall be subject to the DAS LABS LLC Privacy Policy https://www.buckedup.com/information/privacy-policy.
10. CONDUCT: By entering this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor that shall be final and binding in all respects. The Official Rules will be posted at https://promo.buckedup.com/Railbird-Sweeps throughout the Sweepstakes Period. Any information collected shall be in accordance with the DAS LABS LLC Privacy Policy available at https://www.buckedup.com/information/privacy-policy. Failure to comply with these Official Rules may result in disqualification. Sponsor reserves the right at its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes or any web site; or to be acting in any manner deemed by Sponsor to be in violation of the Official Rules; or to be acting in any manner deemed by Sponsor to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
11. RELEASE AND LIMITATIONS OF LIABILITY: By participating in this Sweepstakes, all entrants agree to release, discharge, and hold harmless DAS Labs, LLC (“Sponsor”), the Promotion Parties, and each of their respective parents, subsidiaries, affiliates, partners, shareholders, divisions, officers, directors, members, managers, representatives, agents, licensors, designees, employees, and assigns (collectively, the “Released Parties”) from and against any and all claims, liabilities, damages, losses, costs, or expenses of any kind (including, without limitation, attorneys’ fees), including without limitation those arising out of or related to:
* Participation in the Sweepstakes or any Sweepstakes-related activity (including but not limited to accessing the Website, submitting an entry, or attending any event);
* The acceptance, possession, receipt, use, misuse, or inability to use any prize (including any travel or activity related thereto);
* Any typographical or other error in the printing, offering, or announcement of any prize or in the administration of the Sweepstakes;
* Any injury, illness, loss, or damage to persons or property, including bodily injury or death, resulting directly or indirectly from participation in the Sweepstakes or the use of a prize;
* Any claim based on publicity rights, defamation, or invasion of privacy.
Winners assume all risk of loss or damage to their prize after delivery. Prizes are awarded “as is,” without any warranty, express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose.
The Released Parties are not responsible for and shall not be liable for:
1. technical failures of any kind, including but not limited to hardware or software errors, failed electronic data transmission, interrupted or unavailable network or Internet service, or issues with servers, websites, or providers;
2. unauthorized human intervention, tampering, or hacking;
3. failure of any email or entry to be received due to privacy settings, spam filters, or technical issues;
4. errors or delays in the administration of the Sweepstakes, the processing of entries, or the announcement of the winners;
5. damage to any computer, mobile device, or property resulting from downloading materials or otherwise participating in the Sweepstakes.
Sponsor reserves the right, in its sole discretion, to cancel, suspend, or modify the Sweepstakes or any part thereof, if any fraud, technical failure, human error, virus, bug, tampering, unauthorized intervention, or other cause beyond Sponsor’s control impairs the integrity or proper functioning of the Sweepstakes. This includes but is not limited to acts of God, pandemics, epidemics, weather, fire, strike, acts of war or terrorism, governmental orders, or other force majeure events. If terminated, Sponsor may, in its sole discretion, select winners from all eligible, non-suspect entries received up to the time of such termination. In the event of any conflict or inconsistency between these Official Rules and any promotional or marketing materials, these Official Rules shall prevail.
BY PARTICIPATING, ENTRANTS AGREE THAT TO THE MAXIMUM EXTENT PERMITTED BY LAW:
1. ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES OR ANY PRIZE SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY A COURT OF COMPETENT JURISDICTION LOCATED IN THE STATE OF UTAH;
2. ANY CLAIMS, JUDGMENTS, AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, NOT TO EXCEED TEN DOLLARS ($10.00);
3. ATTORNEYS’ FEES AND OTHER LEGAL COSTS WILL NOT BE AWARDED OR RECOVERABLE; AND
4. UNDER NO CIRCUMSTANCES WILL ENTRANTS BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANTS HEREBY WAIVE ALL RIGHTS TO, INDIRECT, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES.
Some jurisdictions may not allow limitations or exclusions of liability for incidental or consequential damages or limitations on the ability to seek certain remedies, so some of the above limitations may not apply to you.
Each entrant represents and warrants that they have not assigned, and will not assign, any claims arising from participation in this Sweepstakes to any third party, including their own parent companies, subsidiaries, or affiliates.
Sponsor's use of personal information collected in connection with this Sweepstakes is subject to its privacy policy located at https://www.buckedup.com/information/privacy-policy. Any communications between entrants and Sponsor, Administrator, or any of Sponsor’s agencies (including phone calls, emails, chats, or texts) may be recorded for quality assurance and training purposes. Winners’ names may be included in a publicly available winner’s list, as permitted by law.
12. MISCELLANEOUS: These Official Rules contain the full and complete understanding with respect to the Sweepstakes and supersede all prior and contemporaneous agreements, representations and understandings, whether oral or written. The headings herein are for convenience only, do not constitute a part of these Official Rules, and shall not be deemed to limit or affect any of the provisions hereof. No amendment to, or waiver of, any provision of these Official Rules shall be effective unless in writing and signed by both Sponsor and Administrator. The waiver by Sponsor or Administrator of any provision of these Official Rules shall not constitute a waiver of any other provision herein. The rights and obligations hereunder may not be assigned by Entrants, whether by operation of law or otherwise, without the prior written consent of Sponsor, and any attempted assignment in violation of the foregoing shall be null and void. These Official Rules shall be binding upon, and inure to the benefit of, the permitted successors and assigns of Sponsor, Administrator, and Entrant.
13. WINNERS' LIST: For the name of the winner, send a self-addressed, stamped envelope, postmarked by June 9, 2025 to 2025 BUCKED UP® x RAILBIRD Sweepstakes WINNER LIST, Bucked Up HQ, 815 W. University Pkwy, Orem UT 84058.
